These Terms of Service (“Terms”) govern your access to and use of https://9rgw.ca (the “Site”) and your purchase of products from 9Rivers Lutherie Superstore (“9Rivers,” “we,” “us” or “our”).
By visiting the Site, creating an account or placing an order, you agree to these Terms, together with our Privacy Policy, Shipping Policy and Return and Refund Policy.
If you do not agree with these Terms, you should not use the Site.
1. About Our Store
9Rivers Lutherie Superstore is operated from Surrey, British Columbia, Canada. We design and sell tools and accessories for guitar building, repair and maintenance.
Our online store is hosted by Shopify, which provides the ecommerce platform used to display products and process orders.
2. Eligibility
You must be at least the age of majority in your province, state or country of residence to make a purchase through the Site, or you must use the Site with the involvement and permission of a parent or legal guardian.
You agree to provide current, complete and accurate information when placing an order or creating an account.
3. Products and Professional Use
We make reasonable efforts to describe and photograph our products accurately. However, colours, finishes and appearance may vary slightly because of manufacturing tolerances, materials, lighting and display settings.
Product dimensions and specifications may be subject to reasonable manufacturing tolerances unless otherwise stated.
Many 9Rivers products are specialized tools intended for guitar builders, repair technicians and experienced users. You are responsible for selecting the appropriate product, understanding its intended use and using it with suitable care and skill.
Improper use, excessive force, unauthorized modification or use outside the product’s intended purpose may damage the tool, instrument or other property. To the extent permitted by law, 9Rivers is not responsible for damage caused by misuse, improper installation, unauthorized modification or failure to follow applicable instructions.
4. Product Availability
Product availability is subject to change without notice. Adding an item to your cart does not reserve it.
We may limit the quantity of a product available to any person, household, account, geographic region or order. We may also discontinue or modify products at any time.
If an ordered product becomes unavailable, we will contact you and provide an appropriate refund or other available option.
5. Prices and Taxes
Prices are displayed in the currency selected for your market or shown at checkout.
Applicable sales taxes, shipping charges and other fees will be displayed before you complete your order. International duties, import taxes, customs charges and brokerage fees are generally not included and remain the customer’s responsibility.
We may change product prices at any time. Price changes do not affect orders already completed, except where correction is permitted by applicable law because of an obvious pricing or technical error.
6. Orders
Submitting an order is an offer to purchase the products listed in the order.
After an order is placed, we will send an electronic confirmation containing the available order details. Please review it promptly and contact us if any information is incorrect.
We reserve the right, where permitted by law, to refuse or cancel an order because of:

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.
7. Payments
You agree to provide valid and authorized payment information.
Payments are processed by Shopify and the applicable payment provider. Your use of a payment service may also be subject to that provider’s terms and privacy policy.
We are not responsible for fees charged by your bank, card issuer or payment provider, including foreign-exchange or international transaction fees.

Delivery dates and transit times are estimates unless expressly stated otherwise. Delays may occur because of carriers, customs, weather, service interruptions or other circumstances beyond our reasonable control.
Nothing in these Terms limits any cancellation, delivery or refund right that cannot legally be excluded under applicable consumer-protection law.
9. Returns, Refunds and Warranties
Returns, exchanges and refunds are governed by our Return and Refund Policy:

Certain products may also be covered by a specific written warranty or the 9Rivers Lifetime Promise. When a product page includes a specific warranty, that warranty applies in addition to any rights that cannot be excluded under applicable law.
Warranty coverage does not ordinarily include normal wear, cosmetic changes, accidental damage, misuse, improper maintenance, unauthorized modification or use outside the product’s intended purpose unless the applicable written warranty states otherwise.
10. Accuracy of Information
We make reasonable efforts to keep information on the Site accurate and current. Occasionally, the Site may contain typographical errors, inaccurate descriptions, incorrect prices, availability errors or omissions.
We may correct errors and update information at any time. If an error affects an order you have already placed, we will notify you and provide any remedy required by applicable law.
11. Accounts and Security
If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity conducted through your account.
You must notify us promptly if you believe your account has been accessed or used without authorization.
We may suspend or terminate accounts that appear to be fraudulent, abusive or in violation of these Terms.

Purchasing a product does not transfer ownership of any intellectual-property rights associated with the product or its design.
You may view and use Site content for personal, non-commercial shopping purposes. You may not reproduce, distribute, sell, publish, modify or commercially exploit Site content without prior written permission from 9Rivers, except where permitted by law.
14. Feedback, Reviews and Submissions
If you submit feedback, photographs, reviews, suggestions or other content to us, you represent that:

We will not publicly identify you beyond the name or information you chose to provide for publication without appropriate permission.
15. Third-Party Services and Links
The Site may contain links to or integrations with third-party websites, payment providers, social-media platforms, shipping services or other services.
We do not control third-party services and are not responsible for their content, availability, security or privacy practices. Your use of a third-party service is subject to that provider’s own terms and policies.

17. Disclaimer
We endeavour to keep the Site available and functioning properly, but we do not guarantee that access will always be uninterrupted, timely, secure or error-free.
Except for express product warranties and rights that cannot be excluded under applicable law, the Site and its content are provided on an “as available” basis.
Nothing in these Terms excludes or limits any condition, warranty, right or remedy that cannot lawfully be excluded or limited.
18. Limitation of Liability
To the fullest extent permitted by law, 9Rivers and its owners, employees, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential losses arising from use of the Site or products, including lost profits, lost business, lost data or loss of opportunity.
Where liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence or any other liability that cannot legally be excluded or limited.
19. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless 9Rivers and its owners, employees and contractors from third-party claims, losses and reasonable expenses arising from:

This section does not apply to the extent a claim was caused by the negligence or wrongful conduct of 9Rivers.
20. Termination

Provisions that by their nature should survive termination—including intellectual-property, liability and dispute provisions—will remain in effect.
21. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect.
22. No Waiver
A failure or delay by 9Rivers in enforcing any provision of these Terms does not waive our right to enforce it later.
23. Entire Agreement
These Terms, together with the policies and information expressly incorporated by reference, constitute the entire agreement between you and 9Rivers regarding use of the Site and purchases made through it.
24. Governing Law
These Terms and any dispute arising from them are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict-of-law principles.
Subject to any mandatory consumer-protection rights that allow a dispute to be brought elsewhere, the courts of British Columbia will have jurisdiction over disputes relating to these Terms.
25. Changes to These Terms
We may update these Terms periodically to reflect changes in our products, services, business practices or legal obligations.
Updated Terms will be posted on this page with a revised “Last updated” date. Changes apply prospectively from the date they are posted unless otherwise stated or required by law.
